Types of Marriage & Family Visas

The US provides many visa options that allow you or your loved ones to reside legally in the country.

  • Family preference visa: Available to other relatives of a citizen, including children who are unmarried and over 21, children who are married, and siblings
  • Family preference visa (for a green card holder): Available to relatives of a lawful permanent resident, including a spouse and children of any age who are unmarried

It is important to note that the US allows unlimited immediate relative visas. However, the US limits the family preference visas they permit each year. 

What to Know About Fiancé Visas

What can you do if you are engaged to someone who is not yet a US citizen? This question could cause you a great deal of anxiety. However, you should not despair. You can seek a fiancé visa—known as a K-1 nonimmigrant visa. This visa allows citizens to bring their foreign citizen fiancé to the US so they can marry. It is a temporary visa that requires couples to get married within 90 days of the fiancé entering the country. 

Who Qualifies for a Fiancé Visa?

To be the beneficiary of a fiancé visa, you must:

  • Intend to get married within 90 days of your partner’s arrival in the US
  • Be unmarried
  • Be at least 18
  • Not be blood-related to your partner
  • Have met your partner in person at least once in the two years prior 

Immigration authorities must also receive evidence that your marriage will be bona fide. Evidence can include correspondence, proof of travel with your fiancé, and supporting statements from family and friends. 

A fiancé visa is a pathway to permanent residency. After marriage, your spouse can apply for a green card.
